The Coalition for Fair Employment in Construction is utterly sick of the politicians, environmental lobbyists, and union officials telling everyone that abuse of the California Environmental Quality Act (CEQA) is a lie propagated by greedy residential, commercial, and industrial developers. Now our extremely-thorough CEQA analyst friends at Phony Union Tree Huggers are helping to set the record straight.

Exposing the truth about CEQA abuse is perilous. When Jennifer Hernandez of the law firm of Holand & Knight had a comprehensive study published in August 2015 about widespread CEQA litigation abuse, the usual politicians, environmental lobbyists, and union officials were livid. They have relentlessly tried to undermine the study and attack the credibility of its author.

They attack because the study is effective.

"In the Name of the Environment" identified and analyzed all CEQA lawsuits filed in California over a three-year period and recommended reforms to rein in CEQA litigation abuse. Some of those reforms include "extending transparency mandates to CEQA lawsuits, eliminating duplicative CEQA lawsuits for the same plan or project, and aligning extraordinary judicial remedies such as injunctions with conventional civil litigation practice."

Of course, much of the CEQA abuse occurs long before the abusers have to initiate a lawsuit, and that information is much less accessible to the public. Construction trade unions routinely submit massive objections at the last minute to mitigated negative declarations and environmental reviews. They try to delay proposed projects, cause unnecessary and unjustified controversy, and impose painful cost increases on developers. If the developers agree to sign a Project Labor Agreement giving unions a monopoly on the construction jobs, then the environmental threats are "mitigated" and the objections go away.

Above are downloadable tables in various formats with links to 79 cases of construction unions abusing the California Environmental Quality Act (CEQA) from January 1, 2014 to August 7, 2017. Each of the 79 cases has links to the source documents. The CEQA analysts at Phony Union Tree Huggers believe they have identified most of the abuses, although they did tell the Coalition for Fair Employment in Construction that there are probably several more cases that are evading their monitoring systems.
